Thanks for all of the responses guys. So to try to answer a few of the questions:

She was being stubborn by denying she ran a red light, even after the cop took the witnesses statements. My mother was the closest to the area so she came to pick me up. My mom works for a law firm and made it very clear to the lady that she could handle this the civil and simple way, or the hard way.



All of the witnesses were strangers. I am not exactly sure what happened after the impact. All i know is that instantly some lady was talking to me through my speakers, i told her my position and what happened and BMW emergency assistance or whatever its called, contacted the police and emergency people immediatly.

I already spoke with one of the attorneys that my mother works for and he seems to think i will be just fine. he wants me to go see my primary physician tomorrow for a follow up. He told me he handled a case exactly like mine a few months ago and he got the victim $20,000 after her car was paid for. Now I am not looking for any hand outs, but if this old lady continues to deny the fact that she was at fault and tries to fight me, I will pursue her for the pain and suffering, hospital bills, and loss of work that will be associated with my scenario

I already went and talked to my salesman at the BMW dealership today. The E90 that i just wrecked was just bought on December 19th of last year. They had a pretty clean black 2009 335i on the lot with 11k on the odometer. Hopefully it will not take too long to get a nice insurance check. I will keep you guys informed.

same thing happened to me about 2 years ago. i was in my E36 driving to class when all of a sudden some stupid bitch just drove through an intersection. i t-boned her and totaled my car. she was in a big fucking like suburban and drove off.

I was thinking the exact same thing. That scenario might actually benefit my case. That would further more prove my statement and side.
