I have no problem holding up a cellphone to tape something while driving. It's a passive action; you're just facing it in the right direction.

He was following the guy at a safe distance.

He wasn't being a drama queen. That driver was a serious hazard to multiple people and I'd be saying "oh shit oh shit" if I saw someone cross into another lane with multiple oncoming drivers.

Apparently the driver being chased is confirmed as a teen that was texting. The video was sent to the police department.
