I have much respect for our police officers and don't think I am against them... but I have always thought about this fact. I really, really hate how cops tailgate you. I understand the reasoning they want to stay close in case you book it, but what happens if the opposite happens? What happens if a cat jumps out into the street and I don't feel like killing pussy today? I wish they would back off a little...

I think both could be at fault here, the guy braked way too hard while the cop followed too closely. However, if you actually read the article it says they have two eyewitness that support the defendant so the cop could be at wrong here. It's a real shame if the cop indeed lies.

Cop is at fault. 2-3 feet? Imagine 2-3 feet with your hands right now. That is WAY too close to be following someone in a car, never mind a motorcycle... Then to turn on your siren which automatically triggers a "brake and look" response in everyone... that's just asking for trouble.

hard call. my sympathy goes out to the BMW driver just for his age and having the convertible down i can totally see how this happened.
I personally think the cop would be a at fault because its his job to asses possible situation and react accordingly especially if he is the one engaging another person. but over all the should just scrub it, both parts walk away and agree to fix their property and be done with it but very interesting find Thanks for sharing |

Cop should be fired and charged with filing a false report, his bosses should be demoted/fired, and the prosecutor should be relieved of their position. All of them are abusing their power and trying to take the blame off the police officer and place it on a innocent driver.
I normally would take a cops side, but in this case two independent witnesses both corroborated the story of the driver. The police WAY overstepped their boundaries. Why was he even pulling over the BMW in the first place? The guy was stopped at a light so he wasn't speeding and he didn't accelerate away at a fast pace according to the witnesses. I hope the driver wins and sues the prosecutor, the police department, and the officer.

This is a curious situation. And, we are all basing our opinions on a single media sources version of the story. Without really knowing what happened prior to the crash, its unrealistic to make snap judgements.
I have witnessed so many rage events while on patrol that its possible there was a prolonged incident that preceded the crash. No matter what, the officer has a responsibility to maintain a safe distance while initiating a traffic stop and he clearly didn't do that. If the fact of the case are true as presented, it looks like the PD trying to CYA, and that's plain wrong. Its also very easy to disprove so I question whether or not the story we've heard is complete. |
