Got Pulled Over- Can I fight the power?
So, pull on to this one-way street, 2 lanes, both going the same direction. I am behind one of our "Cat-tran" busses (VERY SLOW, lots of stops). So, I pull into the right lane, behind the bus, then quickly pass using the left lane. I was doing probably 35ish, speed limited posted is 20. I slow down and keep driving for 30 secs or so and pull up to a stop sign (and fully stop) I see flashing lights in the mirror, this unmarked comes from at least 150 feet behind me pulls me over. Dum de dum, I get a ticket for 10 over, after telling the cop I had accelerated for overtaking. No sympathy from the devil.
Oh, brilliant e90posters, what should I do? Do I have a chance in court?

Cops are just dicks sometimes. Maybe he was a new cop who hasn't developed a good judgment call yet.
If you have a few points on your driving record, I say go fight it. Heck the cop might not even show up in court. Sometimes it's just easier to pay the fine and go to traffic school. Good Luck. |

meh, that's kind of what I though. Such Arizona police bullshit. Literally, some of the worst police I have ever had the misfortune to deal with.

Your best chance is showing up in court and hopefully the officer won't show. This doesn't mean you'll automatically win though, as the judge can grant the prosecution a continuance. This doesn't happen all the frequently from what I've heard, so if the cop doesn't show it's more likely that your ticket will be dismissed. Then again, the odds are the cop will show.

Is there anywhere in the Country where a moving violation is $50?? Parking tix in NYC are $150.00. 10 over the limit in my area is at least a $200.00 fine + fees.

Yeah, "10 over" when the speed limit is 20 MPH is going 50% over the limit. Areas that are 20 MPH are usually school zones or high pedestrian areas.
You admit to the speeding, so what's the problem? Sometimes you get caught, sometimes you don't....

C'mon dude. The cop could have easily let it go. He was going 35 just to pass the bus; it's not like he was trying to race another car or driving recklessly. He slowed down after he passed the bus. He was going 35 mph for 2 seconds and the cops gives him a ticket? That's being a dick bro.

Any more, 10 over gets you a ticket. Hell, with the coffers so lean in many cities, I'd surprised if 5 over doesn't get you a ticket....

Not a cop and not trying to bust up your balls. I'm not being defensive, just realistic. I speed all the time on the highway (80-85 in a 65) and I know if my radar detector doesn't alert me soon enough, or if I just get careless, that I'm going to get a ticket. That's simply the price of admission. I'm not going to blame the cop for doing his/her job. And even though I speed on the highway, I NEVER speed in residential or city streets because I know cops are far less forgiving when people speed in pedestrian zones. Just gotta be patient and more careful. |

Yes we are. In fact, it's part of our training in the "Developing good judgement call and knowing when to ignore it." They actually show your picture in the class too.
