Returning A Lease....

Not understanding why this is, but since late 2008 to now, my 335i sedan has been at the dealer's service for more than 7 times. Out of that 7 times, 5 of them was to fix the same problem, that is long cranking. This happened regardless if it was first start in the morning, going out for lunch or return home from work. It seems to me that the dealer can never fix this problem.

Over this past weekend, the very same problem happened again. I am schedule to bring the car back. So my question now is since my car is a lease, and the car is not due until end of this, can I request a termination of this lease because of this problem?

Has anyone experience this similar problem? The more I think about, the more I felt that it could be a manufacture defect on the car. It has nothing to do with the dealer's technician. The reason I said so is because after a week of getting the car fixed, I was successful driving (without problem) for nearly a month before the same problem took place.

So please feel free to give me your valuable advice. Thanks.

Call BMW Canada and file a complain.

or simply talk to you dealer into a lease swap. Threat them with the lemon law if they try to talk you out of it.

Has the dealership replaced the hpfp? Or do they keep giving you the car back due to the pump not failing yet, even though it suffers from the hpfp failure symptoms?

I have had a leased car taken back by the manufacturer before under the lemon law in California. Sounds like that would apply here as well, since the lemon law generally means 4 unsuccessful attempts to fix a problem in the first 18K miles of the car's life.
