Cracked Windshield?
This crack comes from the bottom of the windshield from beneath the rubber and then run all the way across to where the vin is. This thing had to have happpened overnite cause there is no way I just happened to miss this. My question is, should this be covered under the warranty. Cause there is no rock chip that started this or anything I have done.

Are you serious you don't see that long line in the pictures. In the first picture its right in the middle of the picture. In the second pic it starts at the botom then moves right, and the thhird its wiggly.

Put a sticker on the glass near the crack and retake the pictures. Give your camera something to focus on, because your current pics are quite blurry.

I see it but honestly I don't know how the dealer would cover it. Take it and see what they say. Nothing to lose and a new windshield to gain which cost about $500.

It looks like it started low then came up and went to the right. Its long as hell, i'm wondering how could they blame this on me, this thing cracked on its own.

Those cracks tend to start out small and just work its way into a longer crack. I would just take the hit and go become a member of the BMWCCA and save yourself some money buying the glass. Not worth mentioning it to your insurance company.

Check with your insuance, a lot more of them cover windshield replacements for $50-100. I've had the 06 325 windshield replaced twice, $50 each, with no change in premiums. YMMV

The most important thing is, that you get a OEM molding for your windshield it will look so terrible with an aftermarket molding. Trust me we work on hundreds of these a month and the brand of the glass does not matter as much, as if you have a quality OEM Dealer molding.
