I just feel bad for the driver of the Volvo. Any pedestrian in the street, even dumb-asses who have abandoned their cars to do some stupid ass dance in the middle of the street, still have the right of way. Wouldn't take even a rookie lawyer to win that case. "Was the plaintiff in the street, in full visibility of you the driver, for a full 5 seconds before you hit them?" Yes, yes he was. Case closed and we have a new millionaire, ladies and gentlemen.

The driver was involved in the video, it was one of the guys friends. He was planning to jump on the hood of the car but he slipped and it looks like the car was moving too fast.
But yes, these people are idiots.

It all depends on the local laws....
As a general rule of thumb, motorists must take every reasonable step to ensure they do not collide with other motorists, pedestrians, etc. If the pedestrian was jaywalking for example it doesn't absolve the motorist from any liability as they still have to pay attention. It's called contributory negligence and it will affect the plaintiff's case and limit the amount of compensation they may be entitled to under the law. Now if the pedestrian is acting irrationally or is emotionally distressed or attempting suicide(yes, I've seen cases like that too) the driver will likely not be held liable for the damages |
