pretty much agree with most of the sentiments already stated, but what were you thinking trying to box this guy in? Seriously? Its like having a "ride me" sign on your back in prison.
Ive been in those situations myself and best thing is to get out of the idiots way and report him. The next fastest car upahead would yield to him and hopefully a little later his ass gets nailed by a trooper. Im glad you're okay and didnt suffer any injuries but consider yourself lucky- pepper spray against a 45 ????? Think before you Act- and next time play it safe. |

bmwexecutive, be thankful you survived the chase, the possibility you got shot, and the impact with the F-150. I would also think that you did the world a great deal of goodness by just reporting the recklessness of the kid and let the authorities do what they are trained to do. gl on the insurance and your health

I think he was just coming out to admire the e90's stunning braking power. so you should show him the e90's stunning acceleration (and windshield rigidity) too. so I second option #1.

See, until you really piss me off, I'm not very confrontational, but now I'm pissed and this guy will feel the brunt of the legal system. People like n1smo can call me names and stand on their heads, but I am hiring a lawyer and going to work on this guy in court. At the bare minimum, he will have to cover the damages to both cars plus pay me some kind of a fee in the civil suit I'll be filing. What I'm hoping is that this kid will also get a suspended license and possibly probation. Not to mention, his insurance company may cancel him. I'm going to make this kid seriously regret tailgating me that day. He might even be in for an ass whopin' from his father. Don't worry, everyone. This is just the beginning. |

You say the guy in the black suv left the scene of an accident. He wasn't involved in the accident. Would you expect everyone who was around when you hit the F150 to stop and wait for the police to show up. My guess is the insurance co of the guy that you hit is gonna go after your insurance to fix his car. He may not have your insurance info now, but he will after he gets the police report. BTW, he's not gonna be charged with reckless endangerment/driving unless a cop witnesses him doing so. Sorry, it doesn't matter how many witnesses you have seeing him weave in and out of traffic but it's just not gonna happen. And now you want to sue this guy for 10k? Why not 50k or 100k? It seems to me like right now, your the only one with any Rage. Sorry, but I have little sympathy for you. Sorry this happened and I hope everything turns out OK for the guy driving the F150. |

Deductible applies
Anytime you use collision coverage, you deductible applies. You are at fault since you pulled in front of the truck. Even if you are not at fault, using your coverage, the collision deductible will apply.

A little devil's advocate of my own. If you boil out the venting nature of the incident into a bare-boned timeline, I think it would be difficult to find fault with the OP. Yes, he made some questionable decisions - but hardly anything illegal. Maybe speeding to close the gap and possibly following too close in the attempt at preventing the pass - all would need to be prosecuted with a witness capable of determining beyond a reasonsable doubt that he, in fact, did such. I think in the end he showed that he did NOT prevent the pass - which would kill any claim by the listed offender as a victim. We also must question the intent. The OPs intent was what? And what was the offenders? Therein lies the issue. All these monday morning QBs here... I say leave it to the professionals. Glad you went home safe. Quote:

You had one of those crappy days that really should not happen to nice people. You will work it out with your insurance company, fix your car, move on, recognize that life is unfair sometimes, and let idiot drivers just go around you next time. I am sorry this happened to you and your beautiful car! Best of luck and keep us posted.

-Be grateful the guy didnt shoot you. -Be grateful you didnt rear-end the black SUV or you DEFINITELY would have been at fault. -Claim it on your insurance, get the car fixed, and consider it a lesson learned. DONT GO THINKING YOU CAN SUE. You are only wasting your time and money, and if that guy in the black SUV really is crazy, AND you attempt to sue him, he WILL come to your house with a GUN. And please, understand in your situation, I probably would have made the exact same decisions, from provoking the guy a little, and trying to get the hell out. However, its over and done, let it go now. |

And actually, a cop might have witnessed him tailgating me because 1,000 feet before the accident there was a cop in the next lane. I slowed down to try to get his attention but after about 5 seconds he turned off. So maybe, just maybe, this cop saw it happening, I can locate the cop (maybe he will speak up after hearing of this incident, if he does), and he can attest to it. Also, I don't buy for a second you statement about "no matter how many witnesses you have seeing him weave in and out of traffic but it's just not gonna happen." A lawyer will decide that. |

Indeed I will have to initally pay my deductable, but I will get it back within a month as it will be paid by the other guy's insurance. And no, I am not at fault. The kid in the SUV that fled is at fault for causing the accident. |
