It's called discretion, leeway, and judgment. The police and justices use it every day.

It's not irrational for the OP to think the cop could have cut him a break with a warning.

If we were all universally cited for every law we break, then it would be wrong for the OP to be upset with the cop. However, precedent has been set and that includes the police using discretion.
"Discretion" is the problem...how about one swat with the baton...or maybe one bullet point blank range...or unloading a whole clip into a car with tinted windows then reloading and emptying another...people should just follow the law and accept their consequences when they break them. I expect the people that we pay to enforce the laws to enforce them without abusing their power. We can't have it both ways.

I'm not sure one thing you said was coherent, relevant, or meaningful to this discussion.

If we follow your "logic", then we would either have the death penalty for any crime against society, or we would have no punishments at all.

Are you so naive and ill-informed that you don't know police and judges use discretion every day? It is part of our legal framework.

The cop used his discretion - it's just that he decided to use it in a way that you don't agree with.

Had he warned the OP and not ticketed him do you honestly believe he would have gone home and removed his front tint and replaced his plate? If the police officer gives a warning he has to believe that this would be enough to change the OP's behaviour.

OT: you might want to check crime rates in US cities compared to Canadian cities before talking nonsense about safety and the need to "protect" yourself with guns. If I recall correctly there are fewer murders per capita in Toronto than <b>any</b> large US city. We're quite happy without them, thank you.

Because those major cities here have OUTLAWED guns. LA, Chicago, Detroit, Washington DC, New York, and the list goes on. They all prevent law-abiding citizens from owning a firearm to protect themselves, so the murderers, drug dealers, rapists, and thieves prey on the innocent with relative ease. In other words, they fear nothing but themselves and their kind.

Check the stats for cities and states where the legal, licensed possession is allowed, and you will see a vastly different story.

To the OP: Don't hate the players, hate the game.

Cops are just enforcing the laws. If you don't like the laws, lobby for change! Increase speed limit, decrease pedestrian right of way, etc. There's more than one way to skin a stupid cat :P

Okay let me give you the short bus version. Laws are written and have penalties associated to them; for example, if you go so many miles over the speed limit then the fine is X amount of dollars. I think that if each officer uses personal descretion it leads to inconsistancies in how the citizens are treated based on personal preference. My comments about police brutality is that the personal descretion is why we have unarmed citizens being excessively attacked and or killed. I would prefer that the letter of law is followed without descretion...or leave the descretion to the judge not the enforcer on the street. If i am speeding I should get a ticket, then I should explain to the judge that I was on the way to the hospital to see my terminally ill family member. The judge can decide if I should be punished...not the officer.

So then I take it you are a fan of max-speed limiters, traffic light cams, and heck, while we're at it, let's install a gps tracking monitor in everyone's car and tie it in to all the speed limits in the US. If your car goes over the speed limit, then you should get a ticket in the mail.
