I found over the years that it's best to just be polite and confident in your position from the get go. Don't be a young whippersnapper dickhead stomping in and demanding this our that --which is sooo easy to do because of the pent-up frustration. State your case and frustration as if you are speaking to your superior at work trying to convince them of something important. In my case I expressed how disappointed I was with this being my third BMW purchased over the years. When I was told it would be 8-10 week wait typically with a give-or-take a couple weeks. Doubling that wait was not my expectation from how I interpreted that estimate to be or I would have made a different decision. I also used the crappy weather out today as the very reason I choose to make the decision to order when I did and to do everything I could to avoid this very moment. From there it was into the previous post I have above about what could they do to make it right. That is my advise. Keep calm. Think about the words you want to say before getting there, Think of how they could respond to those words and have rebuttals ready to support your position. At the end of the day you really only have two option; what they will do or not do for you, or you just walking away even if that means loosing the cost of ordering directly.

Hehe, I haven't been a "whippersnapper" in many years. I do calm very well, fortunately. I was curious if it was something the dealer offered or if it was something the manufacturer offered. It sounds as if the dealer did right by you. Not sure how much additional, I could get out of them, at 7% off MSRP from the outset. I would have to be a pretty egregious situation for me to abandon my $3k deposit.

Perhaps, I can negotiate some merchandise/accessories, if nothing else.

I’m pretty sure you can always get a refund of your deposit in Ohio until they actually receive the vehicle. In California, deposits have to be fully refundable, and as long as you haven’t bought it, which means you can inspect it at delivery and then turn it down, and get the deposit refunded.

Thank you, yes, after researching a bit, you’re correct they’re required by law to refund it. Good grief though, the thought of going through this madness anytime again soon though is more than I can wrap my brain around. lol

Y'all are ruining it for Todd. What if he gets no freebies? I got 2 BMW key chains. That was it. But my car was not late. It arrived a week late, but that was Spanish Homologation and customs, not BMW's fault.

I forgot to add the dealer had a receiving gift bag ready for me when I arrived it had a BMW travel mug, BMW umbrella, and a BMW key chain.

Focus on the discount first, and if they are stingy on that and there are accessories or services you are interested in getting in exchange for a discount, press for those. I don’t think they have much I want, so again I’d press for a discount. This is a very dealer discretionary thing. If you are nice and they think you might become a repeat customer, they will do something for you. If you are a jerk, they can blow you off. Remember, whenever the deposit is refundable, there’s no actual obligation to provide you with the product on a set timetable, because you can always have your money back and walk away. This freedom works both ways and is better for both parties. In the case of non-refundable deposits and a no-show car, probably you need to get legal advice on how to proceed.

Legal advice?? This is a contract. Whenever you sign a contract, you should put in contingencies in the contract that protect you. Whether you are buying a car, a house, or whatever, ALWAYS protect yourself before hand in case things go wrong.
All the legal advice will get you is an empty wallet.

I agree with you, but the reality is that getting a non-refundable deposit / contract resolved takes different degrees of effort and legal assistance depending on the location, and I’m not just talking about in the USA. There are difficult dealers out there.

Not when the contract states that the deposit is refundable if car is not delivered by a certain date. What did you not understand? If the dealer does not agree with this, you move on.

I ordered i5 M60 yesterday and the order is in `Order received` state. Some dealer told March for the earliest build month, some of them January or February. I ordered from a dealer with a January build date. Is there a way to get more insight? How accurate is this build date info?

Welcome! I can speak from my personal experience. I wasn't able to get any information regarding when my 5 series was going to be made until it went to Status 150 -Production Begins. When the Production Begins Status is assigned then you'll have a good idea of which week of 2025 it's going to be manufactured. Clearly, not 100% guarantee, as I've read posts from people where it changed.

Now that the catastrophic recall situation is finally resolving, hopefully this means, the dates will be true to promised.

I called the Genius Line once mine was listed as "scheduled for production" status on the app/website, and they were able to give me a build week - and it ended up holding through my build.
