So I read through the paperwork and I think I'm pretty well screwed. According to the paperwork my deposit is non-refundable and I legally agree to take delivery of the car within 5 days of it arriving at the dealership.
The kicker is is that when they asked us to sign it we weren't sure if the car was going to be in my name or my mom's name (insurance reasons) and they said that it didn't matter who signed it. I am however going to call BMW of Sterling and Arlington and see what their policy is that way if Fairfax gives me problems I can make a stink about what the others in the area do. If they are nice they will refund or even at this point just take the 2.5k and not legally bind me to the car. (Though I do hope to get the deposit back.) I feel this would be so much easier if they sold MINIs... I will keep everyone posted to the situation and thanks for the support/input.

gee...try to find another buyer to take over your order. What's the status on the car? Hit up friends/relatives/co-workers who'll be interested to take over....
Btw good choice on the MCS....I think you have the right ideas, wish you all the best with everything incl your new job....

Sounds odd for a legit dealership...... You should really try to get out of it. That car can easily be sold. Do not just give up your $$$ so easily.

Remind him that for his understanding, you will remember to purchase from him in the future and you will send people his way. A good sales person won't care if a deal falls through, b/c he will always have another in the works. Mine sold the one I backed out of in 45minutes.

Go with the MINI. I've driven one (convertible) as a loaner and they're pretty cool! Even though I love my E90, now I'm really starting to wonder how much smarter it would have been to invest that money towards a house. I don't take my car to work anymore b/c I'm afraid of dings and dents, only to school which is only 3 days a week. I spent 40k on my car and I can't say I regret buying it, but I still have a long ways to go towards paying it off. Would I do it again? Not 100% sure...

I just called BMW of Sterling to see what their policy was on ordering a car.
They told me that the deposit was 5% down and it was refundable for extenuating circumstances, not just because you decided you didn't want it anymore. I'm calling my SA to let him know my situation to see what can be done. I'll let ya'll know.

gee...fyi I bought my car from Passport BMW in Marlow Heights, MD ... and their policy is $500 refundable deposit ... no stupid forms/documents to sign other than build sheet. Thought you may want to use that as well....Good Luck and keep us posted.

your plan sounds very reasonable. i don't know why you even think about it.
i wonder if you can redirect the deposit towards the Mini you wanna get (that is, if you dealership sells them). maybe then you wouldn't loose it at all.

another option could be instead of buying a mini....try to get the dealer to apply that deposit to another CPO BMW.
atleast this way you will be saving some $$$.

gee...well..if you're gonna do that (i.e. going out and test driving other cars)....you'd definitely be keeping your e90 order
Don't stress, just take your time. Any progress on getting your deposit back...

How can they prove that you are or are not?? And by what standard means do they have to assess this?? If you do not want it...get your money back. They just do not want to lose the sale, by simply saying to you...yeah its refundable. If you decide that it is better for you to not get the car, then don't get it. Tell them that you cannot get the car and instruct them as to where they can mail your deposit back to you. DO NOT ASK IF IT IS OK. JUST TELL THEM.

I decided I am going to take it but instead of sinking all the $$ into it I am going to lease it at 10k miles a year. Sorry for my mini-freak out. I'm just going to take it and hope for the best because I've already test-driven and considered so many cars and nothing was like the e90...
