Believe or not, Lemon Law applies to used cars as well. OP, in your case, they not only sold you a lemon, if they knew about it that's strike two. Depending on how long your car was out of service, or how many fixes they did, that could be strike three.

My advice, as others here have mentioned, HIRE A LAWYER. IMMEDIATELY. This will get resolved so much quicker and you'll come out smelling like a rose. Seriously. DO IT NOW. |

Sorry to hear OP. I think this is more is used car buying issue than Bmw specific issue.
This sounds exactly why car dealers have a bad reputation. Definitely lawyer up and politely mention this fact to the dealership. |

Did they advertise or tell you the car was accident free when you bought it? Keep in mind that's very different than saying it has a clean Carfax. As you noted, many accidents go un-reported to Carfax. The only way things are reported to Carfax are when someone voluntarily reports or there's some form of public record relating to the incident. Selling a car that's previously been in an accident is not wrong and is done frequently. If they told you it had never been in an accident and it was, then that's another story. You'll need to have proof of that conversation, thus why you are always supposed to get things in writing. Used cars are often in accidents...part of being a used car. Even CPO'd cars can be in minor accidents. Not sure how much that's going to help you. If you like the car, it drives good, doesn't have issues, and you can get the paint to match, I say drive it and enjoy it and move on. The oil usage on the F10 M5's are pretty common.
