+1 on getting a lawyer at the very least. Especially for a thing like this, I really don't think you'll be able to get a good result out of this on your own. When I was in court a few years ago, my lawyer just worked out a deal with the prosecutor and the charges were significantly lowered, even though they weren't bad to begin with at all.

I didn't read your entire case but you are admitting guilt by saying you were going 45-50 so you will get a ticket. Second of all your writing sounds very elementary with lots of improper grammar. Instead of got trying using received, instead of cop use officer, and it's my friend and I, etc. I also think it's unnecessary to mention the jeep and the bmw in the racing part, because to me it seems like you're saying you weren't racing because he was in a jeep, but if it were a different car you might race. Good luck with your ticket, hope you can get something with no points..
Also a bigger issue is that you technically aren't insured. You must be listed under your mother's insurance policy if you live at the same address as her, otherwise insurance may deny coverage if anything should happen.

But since its a civil ticket its hard to beat since basically a cop can say "I saw you speeding" and that will hold up. Since in civil court they do not have to provide prof beyond a reasonable doubt like they would in a criminal ticket. So what you want to ask in court is officer, (play along I know he didnt use radar but ask him anyways) You: Lets say you are using radar and the speed limit is 55mph and a car is coming at you and your radar tell you the speed is 72 mph but in reality the car was going 55, could you tell your radar gun was malfunctioning? Cop: yes You: Ok what if the car was going 60 mph and your radar indicated 72mph could you tell? Cop: yes You: how about 65 mph Cop: probably You: yes or no Cop: no Well their you have reasonable doubt since he cant determine that last 7 mph. So you can ask the cop if it was possible that you were going 58 instead of 65 and if its possible you were going 72 mph instead of his indicated 65. And ask him if he cant gauge within 7 mph how he arrive at that round nice figure of 65 mph.. Its still better to go to traffic school in the end... |
