Once again people fail to understand how the real world works. Voluntary manslaughter is an easier conviction. It's a safe win and 11 years is still a good chunk of time. Don't get too bent on your ideological version of justice. Life isn't fair. The DA saw an easy win and took it. Just like surgeons take easy operations for the stats. It happens. Murder II can be EASILY crushed by someone like me without legal knowledge.

I forgot that this thread existed, so here's an update:

The perp was sentenced to 6 years in jail, and is currently serving his sentence in Shafter Community Correctional Facility (near Bakersfield, CA). He was ordered to pay almost 50k in restitution to my niece. This is a debt that he can't erase, except by paying it.

This type of shit always pisses me off. What a tragic waste of life.
I always wonder though, is my perception of an increased prevalence of these encounters true? And is it due to the increase in stress and value on time and production from our society that drives these incidents or is it simply that news and media outlets are there now 24/7 to report on them?

Regardless, I feel for the loss you feel and that of your families'.

Some of the responses here have been somewhat comical. Just know that people deal with tragic and uncomfortable situations in different ways, some times jokingly. Don't let that discourage you from reaching out to your BMW and car family.

The DA said he had to spend 85% of his sentence in jail. He also gets 15% credit for the time spent waiting for trial. I figured he'd be out in 4 1/2 years.

The DA was working on a Murder 2 conviction, and the defendant claimed "imperfect self defense". The video from the donut shop showed my niece's husband lunging at the perp after he was sucker punched. Seems the 23-year old (and his two friends) was afraid of someone smaller and 35 years older. Disgusting how the criminal justice system in LA sucks. If this trial was in Texas, the guy would be on death row.

I have no problem with the fine people there (well, for the most part) so I hope that comment did not offend you.

To answer your question, my primary reasons would be: California has unacceptable (to me) firearms laws and way too much traffic/pollution.

no offense at all, i was just wondering the reason and if it was related to violence because i was surprised if so.

i agree about the firearms laws but the traffic and pollution is limited to a small percentage of california. california is pretty big.

I cannot stand the traffic in LA/OC county. 20minutes of commute on Sunday is like 70minutes of commute on traffic hours. High cost of living+time wasted in traffic isn't worth for me anymore.

Oh yeah, the firearm law too. I can't even move to CA with all the stuff I own.

I agree. I've been to the Palm Desert area (Rancho Mirage, Palm Springs, etc.) many times to play golf. The scenery is stunning and I don't mind the heat. The people were very friendly too. I've only been to L.A. once but I would love to visit again. I also would enjoy spending some time in Palo Alto and San Francisco.

I'm spoiled here in the State I live in. Traffic is tolerable and the firearms laws are very favorable to supporters of the Second Amendment.
