How did the cop gauge the speed? Was he pacing or was it done through radar/laser? The reason cops usually give a +5/7 range is because just like any other electronic equipment, radar can also be a bit off.

While 66 is technically against the law, it is likely within the margin of error - and I can't imagine any judge would accept it.

I was under the impression that today's radar guns were much more accurate than that.

Anyway, yeah technically 66 is illegal, but a cop would have to be a real homer to write that one up to a cooperative and courteous driver.

As others have said, even one mile over is technically a violation, but that it will get thrown out by the judge.

It is hard to say why your uncle got the ticket. It is even possible that he got the ticket because he was going too slow - 66 in a 65 might be considered impeding the flow of traffic if everyone else was going faster and the cop may have written it as a favor because "impeding" usually carries a higher fine.

In any case, there is a 99.999% chance that it'll get thrown out - assuming it even happened.

The radar gun itself is quoted to something like +/- .1% That is assuming that the officer holds it perfectly steady and aims it at the correct part of the car. If his aim wiggles just a tiny bit, or if he lets it slide along the car even a fraction, the error can go up as high as +/- 7%.

So if he gunned you at 66 mph, you could legitimately claim you were going about 60.

The best fu_k you would be to see the look on the cop's face when the judge tosses the ticket. And if you can get your Uncle to limp just a little, it should be a great day. I'm all for the law within reason, but that is reeeeediculous!

I agree with the majority that it will likely get tossed.

The judges in the county I reside in won't enforce a ticket for anything less than 5 over the limit. In fact, they prefer 10 over or more. One two-cop local municipality has the reputation of setting up speed traps and would try to get away with writing ridiculous tickets (2 over, 4 over, etc.). The judge apparently told the officer that they are wasting the courts time and future citations of less than 10 over will not even be considered.

I know for a fact that our county Sheriff won't even look at you unless you're 10 over or more.

Now...is it a "Speeding Ticket" or a "Failure to Obey Traffic Signs Ticket". In PA you can't get a technical speeding ticket and points unless its at least 10 mph over, I do wanna see this ticket.

The 5 is like California's autobahn, so that is a possibility. Also, it wouldn't be a surprise if a dick officer gave a ticket for 1 mph over.

This only pretty much just confirms that the police can give you a ticket any time they want.

There is a town in Iowa that is notorious for giving tickets for anything over the speed limit, even 1 mph.

I could only find one blog about it, was figuring some of the news stories they had on tv would still be online. It was a big deal a few years ago.

"Let me enlighten you all about Windsor Heights Iowa.
This town is a small suburb of Des Moines.
Boundaries 73rd st to 63rd street west to east.
I 235 to HIckman road north to south. ( no room for expansion)
City wide speed limit is 25 mph except for the stretch of 63rd from I-235 to University which is 35 and University to Hickkman which is 30.

This freaking hell hole is a notorious speed trap, (They make Big Cabin OK look like bumbling idiots).
They have a small force of Barney Fife wannabees, whose rare excitement is setting up on I 235 between 73rd (8th st in WDM and 63rd St)
These people are A-Holes from the word go.
They will write you for 1 mph over the limit, including stopping EMT's and Firefighters if they exceed the limit under Blue Lights going to the scene of an emergency.
I was with their Fire Department in my early years after high school and I cannot tell you how much I hate that town.
If their cops had gotten wind of what this kid did, there is no telling what they
would have done to them.
Oh yea, just for your information if you see a Windsor Heights cop anywhere on I-80 or I-35 or I-235 in the Polk County area and they turn their lights on, you had better stop for them. "
