My Unemployment Case
Hello all and thanks for reading.
I was recently "fired" from Safeway (Which turned into a lay-off due to B.S) The same day I filed for unemployment and now I am receiving unemployment checks. I received a dispute letter from the unemployment office and now need to go to court. I was wondering, if I somehow lose my case do I need to give the money back? I am just in college and have phone bills, auto insurance, gas bills to attend too, but don't want to look to my parents to payback the money if I lose my case. Thanks!! |

I walked into work one day and they said "you need to leave." After almost 2 years of faithful and great work I did. Working with fruits and vegetables was my job. (Only 18) But, almost 2 years is damn long for a person my age to hold a job.

if they determine that you were terminated "for cause" then you have to repay the unemployment...

From the CA EDD website (EDD):

A person who is laid off is out of work through no fault of his/her own. A person who quits work or is fired from work will be scheduled to a telephone interview because there is a separation issue that must be resolved. The Department interviewer obtains and documents information about the separation from the employer and claimant and decides, according to law and regulations, if the person is eligible to collect benefits. The Department mails a notice to the claimant who is not eligible for benefits. The Department mails a notice to the employer who responded timely to the notice of claim filed. The notice advises the employer about whether the claimant is eligible or not, and whether the employer's account will be charged for benefits paid to the former employee. Either party can disagree with an unfavorable decision and file an appeal. ************************************************** ********

The problem is that the employer was asked by EDD the reason the OP left the company. They probably said that he was fired, making him ineligible for unemployment compensation. Remember, the money that CA sends to the OP comes out of the employers account.
The OP needs to get all his facts straight - and have a chat with EDD. OP - PM me and I'll give you my phone number.

That's true, he can appeal. Here in CA, lawsuits are very common.

Right now I am gearing up for battle. Lately I have been going to my Ex-Managers who were transfered to other stores to write up references for me. I will bring these to court with me, anyone else got anymore insight?

if you were fired for no reason you will win the case for sure,, sometimes the managers from your work place wont even show up unless they are assholes and got no life. haha

Definitely, btw it wasn't a guy. A woman that is in her late 40's that is having a huge power trip. To think I was about to start my training for assistant management too.
$23+/hr would of been damn nice for an 18 year old. |
